　　拍卖公司知假卖假、利益集团联手做局、天价拍品层出不穷……2004年起,吴树连续多年暗访国内文物市场,掌握了大量第一手资料,先后写出了《谁在收藏中国》、《谁在拍卖中国》和《谁在忽悠中国》等“文物黑皮书”系列,直指行业内幕.在谈到当前收藏市场乱象时,他痛心地对记者说,“中国文物市场的乱象,远不止‘金缕玉衣’、‘汉代玉凳’等几件天价假文物案那么简单.在投机冲动的异化下,国人好古藏古的文化志趣被‘铜臭气’严重侵蚀.当前的全民收藏,已偏离文化轨道,变成一场不谈艺术、只谈价格的金钱游戏.所谓的收藏,自始至终都建立在追求暴利的幻想之上,以至于在近亿人的收藏市场,几乎只有上家与下家,找不着几个真正的藏家.”

　　那么,在这场金钱游戏中,到底谁是赢家、谁是输家？吴树对记者说,盗卖文物者、制假者、鉴定专家,都能从中获利,但最大的受益者还是拥有足够金融资本的文物艺术品投机商和权力集团.他们掌控了艺术品拍卖的解释权、定价权和话语权,藏品无论真假,经过他们的二次包装——不可交易的出土文物打上火漆就成了可以进入市场的“海归文物”,赝品附上鉴定证书和假档案,摇身一变成了传承有序的“真文物”,堂而皇之地走上市场.他举例说,我们以一件成交价100万人民币的高仿拍品为例,看看这块“肮脏的蛋糕”是怎么分的.出厂价4万,由制假者获利.各项鉴定费用3万,由鉴定专家获利.拍卖公司佣金和国家税收20万左右,但这项经常被偷漏掉.上拍赝品实际所有者,获利73万元.这个实际所有者,就是背后的利益集团.至于受害者,当然是广大藏家.目前的现实就是,95%的人抱着投机心理,掉进了资本操纵的金钱圈套,盲目地跟在后面传接力棒,结果用95%的钱买了95%的赝品,无奈地成了最后一棒.

　　收藏市场如此之乱,根源在哪里？吴树分析说,一是鉴定体制的不完善.当前,我国缺少一套完整的文物鉴定体系,在鉴定机构、鉴定机制、鉴定标准上都有缺失.有些“全能专家”鉴瓷鉴画又鉴玉,结果只能是“像雾像雨又像风”.再加上体制内和体制外的鉴定专家各说各话,更让普通藏家无所适从.此外,现行文物艺术品市场的游戏规则既不合法,也不合理.比如《拍卖法》“61条”就被称为“免责条款”,容恶性很强.按照这一规定,只要事先声明不保真,那买到假的就算藏家活该,拍卖机构不会受到法律追究.这就在客观上起到了纵容不法商人制假卖假、拍卖行知假卖假的行为.对艺术品市场缺乏有效监管也是个大问题.为什么“假拍”现象屡见不鲜,就在于偷漏税太容易了.如果税务部门严格按照拍卖公司的成交额去收税,作假的就会少很多.

　　厘清乱象,如何正本清源？吴树建议说,治理文物市场乱象的根本出路在修法建制.所谓“修法”,就是要对“61条”这样的不良条款进行清理,不能任其充当不法行为的保护伞.“欧美一些国家没有拍卖法,但卖赝品后照样被罚.一些国家甚至将制作、贩卖赝品和造假钞同等入罪.有一位意大利艺术家把自己早期的作品改为晚期作品保护,被判入狱两年.”此外,还能通过《消费者权益法》等法律法规对专家虚假鉴定、知假卖假等行为进行约束.有些国外经验可以借鉴,比如韩国就要求凡是新制的高仿品,上面必须要有制作者的记号,否则就按制假处理.

　　建制也是一个关键问题.吴树说,可以分级建立鉴定委员会,并对民间开放.这里的关键就是要将鉴定真假和利益剥离开来,建立一套完善的监管约束机制,严厉惩处违规行为,把那些故意“看错”的专家清理出去,甚至可以采取终身禁入制.只要有了真正权威的专家,各级鉴定机构就可以效仿劳动仲裁委员会的运作模式,对交易市场出现的纠纷案件进行分级仲裁.与此同时,还要最大限度地将各种科技手段引入鉴定机制,各个科研单位要资源共享,建立一个相对完整的数据库.“只有在修法建制双重力量下,我们的收藏市场才会少点阴暗,多点阳光.”吴树说. (董晨)
